Is my school doing something illegal!?

Okay, so I'm sort of a geek/over achiever. I go to a small school. I'm in band and jazz band, and it isn't possible to fit both of those classes in my schedule for all 4 years with our honors curriculum. This means that I would have to attend summer school. This wouldn't be a problem, if my school had enough funds for it. So they told me that only kids failing classes who NEED summer school can go. Even then, they aren't providing lunches or transportation and the kids take the courses on the computer because they can't afford to pay the teachers over the summer too. Well, just recently I came to find out that they are building a storage unit for the wrestlers and football players over the summer! This wouldn't be terrible if we weren't too broke for open summer school courses, we hadn't survived perfectly fine without it for the past 10 years my school has been here, and I could actually find information about it on our school website. My school pretty much told me to forget ab out my education, then used our money on the sports! Does anyone know any legal trouble that they could be in for doing this?! If so, please cite where I can find proof of it. Thank you for your help!!
